1. Acceptance of Terms

By accessing or using PupBoy, you agree to:

• These Terms of Service
• Our Privacy Policy
• Our Community Guidelines
• All applicable laws and regulations

We may modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the modified Terms. We will notify you of material changes via email or app notification.

3.1 Account Creation

• You must provide accurate, current, and complete information during registration
• You are responsible for maintaining the confidentiality of your account credentials
• You may not create multiple accounts or use another person's account
• You must notify us immediately of any unauthorized use of your account

3.2 Account Verification

• We may require email verification before full access to features
• We reserve the right to verify your identity or age at any time
• Failure to provide verification may result in account suspension or termination

4. User Conduct and Prohibited Activities

4.1 Community Standards

PupBoy is a community built on respect, consent, and safety. You agree to:

• Respect others: Treat all users with dignity and respect
• Obtain consent: Always establish clear boundaries and obtain affirmative consent
• Be authentic: Use current, accurate photos and truthful information
• Stay safe: Meet in public places initially; inform friends of your whereabouts
• Report violations: Use our reporting tools for inappropriate behavior

4.2 Prohibited Content and Behavior

You may NOT use PupBoy to:

• Harass or threaten: Engage in bullying, stalking, intimidation, or threats
• Share illegal content: Post content depicting illegal activities, violence, or child exploitation
• Impersonate others: Pretend to be another person or entity
• Spam or scam: Send unsolicited messages, phishing attempts, or fraudulent schemes
• Share non-consensual content: Post intimate images without subject's consent ("revenge porn")
• Solicit prostitution: Offer or request sexual services for money
• Promote hate: Advocate violence or discrimination based on race, ethnicity, religion, disability, gender, age, sexual orientation, or veteran status
• Misuse the Service: Attempt to hack, reverse-engineer, or disrupt the platform
• Scrape or harvest data: Use automated tools to collect user information
• Violate others' rights: Infringe intellectual property or privacy rights

4.3 Content Guidelines

Profile Photos:

• Must clearly show your face (hoods/masks acceptable for pup play aesthetic)
• No nudity or sexually explicit content in public profile photos
• No photos of minors (under 18)
• Must be photos of you (not celebrities, cartoons, or other people)
• Must be appropriate and non-offensive

5. Intellectual Property Rights

5.1 Your Content

You retain ownership of content you upload ("User Content"), but by posting, you grant PupBoy a worldwide, non-exclusive, royalty-free, transferable license to:

• Use, reproduce, modify, and display your User Content
• Distribute your content within the Service
• Create derivative works for Service improvement

This license ends when you delete your content or account (subject to reasonable retention for backups and legal compliance).

5.2 PupBoy's Content

The Service, including its design, features, code, logo, and trademarks, is owned by PupBoy and protected by copyright, trademark, and other intellectual property laws. You may not:

• Copy, modify, or distribute our code or design
• Use our trademarks without written permission
• Reverse-engineer or decompile the app

6. Privacy and Data Protection

Your use of PupBoy is subject to our Privacy Policy, which explains how we collect, use, and protect your personal information. Key points:

• We collect location data to show nearby users
• We collect photos you upload to your profile
• We store messages you send through the app
• We use cookies and analytics to improve the Service
• We do not sell your personal data to third parties

7. Safety and Reporting

7.1 Report Abuse

If you experience or witness violations of these Terms, you can:

• Report individual users via their profile
• Block users to prevent future contact
• Email us at safety@pupboy.com

7.2 Our Response

We take reports seriously and will investigate promptly. Actions may include:

• Warning: First-time minor violations
• Temporary suspension: Repeated or moderate violations
• Permanent ban: Serious or repeated violations
• Legal action: Criminal activity or threats of violence
• Law enforcement reporting: When legally required or appropriate

7.3 False Reports

Intentionally filing false reports to harass others is a violation of these Terms and may result in account termination.

8. Location-Based Services

PupBoy uses your location to:

• Show you users nearby on the map
• Calculate distance to other users
• Filter search results by proximity

You can disable location services in your device settings, but this will limit app functionality. We do not share your precise location with other users—only approximate distance.

9. In-App Purchases and Payments

(Currently, PupBoy is free to use. If we introduce premium features in the future:)

• All purchases are final and non-refundable unless required by law
• Prices are subject to change with notice
• Payment processing handled by Apple App Store or Google Play
• Subscriptions auto-renew unless canceled 24 hours before renewal

10. Disclaimers and Limitations of Liability

10.1 "As Is" Service

10.2 Limitation of Liability

To the maximum extent permitted by law, PupBoy and its officers, directors, employees, and agents shall NOT be liable for:

• Indirect, incidental, special, or consequential damages
• Lost profits, data, or goodwill
• Damages arising from:
  • Your use or inability to use the Service
  • Unauthorized access to your account or data
  • Conduct or content of third-party users
  • Offline interactions with other users

Our total liability to you for any claims shall not exceed the amount you paid to PupBoy in the past 12 months, or $100 USD, whichever is greater.

10.3 User Interactions

You are solely responsible for your interactions with other users, both online and offline. PupBoy does not conduct background checks on users and makes no representations about user conduct or safety. You should:

• Meet in public places
• Inform friends of your plans
• Trust your instincts
• Practice safe activities

11. Indemnification

You agree to indemnify, defend, and hold harmless PupBoy and its affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your violation of these Terms
• Your violation of any law or third-party rights
• Your User Content
• Your interactions with other users

12. Termination

12.1 Your Right to Terminate

You may delete your account at any time through the app settings. Upon deletion:

• Your profile will be removed from the Service
• Your data will be deleted within 30 days (subject to legal retention requirements)
• Messages you sent to others may remain visible to recipients

12.2 Our Right to Terminate

We reserve the right to suspend or terminate your account at any time for:

• Violation of these Terms
• Fraud or misuse of the Service
• Repeated user complaints
• Legal or regulatory reasons
• Any reason, with or without notice, at our sole discretion

12.3 Effect of Termination

Upon termination:

• All licenses granted by you to PupBoy terminate
• You must cease all use of the Service
• Sections of these Terms that by nature should survive termination will survive (e.g., disclaimers, indemnification, dispute resolution)

13. Dispute Resolution and Arbitration

13.1 Informal Resolution

Before filing a claim, you agree to contact us at legal@pupboy.com to attempt informal resolution for at least 30 days.

13.2 Arbitration Agreement

Any dispute arising from these Terms or your use of PupBoy shall be resolved through binding arbitration rather than in court, except that:

• Either party may seek injunctive relief in court
• Disputes may be brought in small claims court if they qualify

Arbitration Rules:

• Governed by the American Arbitration Association (AAA) Consumer Arbitration Rules
• Conducted via telephone, online, or in-person in your county of residence or San Francisco, CA
• Decided by a single arbitrator

13.3 Class Action Waiver

14. Governing Law and Jurisdiction

These Terms are governed by the laws of the State of California, USA, without regard to conflict of law principles. Any legal action not subject to arbitration must be brought in state or federal courts in San Francisco County, California.

15. Miscellaneous

15.1 Entire Agreement

These Terms, along with our Privacy Policy and Community Guidelines, constitute the entire agreement between you and PupBoy.

15.2 Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will remain in full effect.

15.3 No Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

15.4 Assignment

You may not assign or transfer these Terms. PupBoy may assign these Terms at any time without notice (e.g., in connection with a merger or acquisition).

15.5 Force Majeure

PupBoy is not liable for delays or failures in performance resulting from causes beyond our reasonable control, including but not limited to natural disasters, war, terrorism, labor disputes, or internet service disruptions.

15.6 Digital Millennium Copyright Act (DMCA)

If you believe content on PupBoy infringes your copyright, email legal@pupboy.com with:

• Your contact information
• Description of the copyrighted work
• Location of the infringing content
• Statement of good faith belief
• Statement under penalty of perjury that information is accurate
• Your physical or electronic signature
